DiveLink — INDEMNITY, RELEASE AND ASSUMPTION OF RISK AGREEMENT

I, the undersigned, hereby acknowledge that scuba diving is an activity that involves inherent risks and dangers, including but not limited to: drowning, decompression sickness, barotrauma, nitrogen narcosis, oxygen toxicity, encounters with marine life, equipment malfunction, and adverse sea conditions. These risks can result in serious injury, permanent disability, or death.

Medical Fitness Declaration

I declare that I am in good physical health and know of no medical reason why I should not participate in scuba diving activities. I have not withheld any relevant medical information from the operator. I understand that if I am uncertain about my fitness to dive, I must obtain a medical certificate prior to participation.

Certification Acknowledgement

I confirm that I hold a valid scuba diving certification appropriate for the dive being undertaken, or I am participating as a Discover Scuba Diver under direct supervision of a PADI/NAUI/SSI instructor. I agree to dive only within the limits of my training, experience and certification level.

Assumption of Risk

I voluntarily assume all risks associated with scuba diving, including risks arising from the negligence of the dive operator, its employees, agents, and instructors. I release and discharge Twobar Scuba, Emoyeni Dive Lodge, DiveLink, and all associated parties from any and all liability, claims, demands, and causes of action.

South African Law

This agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. I have read and understand all provisions of this agreement. I am at least 18 years of age, or if a minor, this form has been signed by my parent or legal guardian.

Emergency Contact Consent

In the event of a diving accident or medical emergency, I hereby consent to medical treatment being administered by qualified medical personnel. I authorise Twobar Scuba / Emoyeni Dive Lodge to contact DAN Southern Africa (Divers Alert Network) and emergency services on my behalf.
